REQUEST FOR COMPETITIVE SEALED PROPOSALS

AND NOTICE THEREOF

The City of Dublin and County of Laurens Development Authority (the "Authority") hereby, pursuant to the Georgia Local Government Public Works Construction Law (the “Act”), publicly advertises the contract opportunity to design and construct a new project to be owned by the Authority, and requests Proposals therefor, as set forth below. This document constitutes both a Notice advertising a Request for Competitive Sealed Proposals, as well as the Request for Competitive Sealed Proposals itself (such document, together with any Addenda thereto, the “RFP”). This RFP is subject in all respects to the Act. Interested Offerors must submit Proposals in complete compliance with the RFP, and the Proposal Process, set forth below.

Project: Design and construction of improvement and expansion of existing facility (Waldrep Spec Building) owned by the Authority.

Construction Delivery Method: Design-build. The Authority will award to the successful Offeror a design-build contract (as further defined below, the “Contract”) on AIA Document A191 Part 2 (the “Agreement”), as modified by the Supplementary Conditions contained in the Contract Documents (defined below), and as further modified by the Proposed Modifications, if any, proposed by the Offeror that are acceptable to the Authority in its complete discretion, and as again modified by the Negotiated Modifications, if any, that may be reached pursuant to any negotiations, as described below. Offerors may obtain a complete set of the existing Contract Documents from the Authority at its address set forth below, at a cost of $100 . The Contract will provide for compensation to the successful Offeror on the basis of a stipulated sum (lump-sum). The Authority shall have the right to reject any or all Proposals and to waive technicalities and formalities.

Competitive Award Method: Competitive Sealed Proposals.

Conceptual Program Information/Description of Requested Services: The following details and specifications are only intended to be such as will enable the public to know the extent and character of the work to be done. The Scope of Work includes design as well as construction, and complete plans and specifications will not be available prior to award. The Authority reserves the right, subject to the Act, to issue Addenda to the original RFP. Where there appears to be a conflict between the RFP and any Addenda issued, the last Addendum issued will prevail.

Project Location: Project will be located in the City of Dublin, Laurens County, on the site described in Exhibit A attached hereto, the same being located in the Authority’s industrial park; the Authority is the owner of the land and existing building, which will be improved and expanded pursuant to this Proposal.

Site Size: 13.81 acres, more or less.

Project Size and Materials: The Project includes:  grading, paving, site work, a 10,000 square foot addition to the existing building, interior building improvements, and storm water retention design, permitting, monitoring and construction as specified in the Contract Documents.  The building addition shall match existing construction with the exception that it shall be open on three sides; all interior floors shall be 6 inch, 3,000 psi reinforced concrete.  An 11,600 (total two floors) square foot, two story interior office area shall be constructed.

Anticipated Schedule: Start date: July 12, 2004 (all Offerors must commit to commence construction on that date). Anticipated duration of performance of Contract: approximately 120 days. Anticipated completion date: November 9, 2004. Offerors must include an agreed substantial completion date in their Proposals, which must be on or before November 9, 2004.

Contract Documents: This procurement shall be governed by the Contract Documents, which are listed below. Each of the Contract Documents has the precedence over the others corresponding to its numbering below; i.e., Contract Document (1) takes precedence over all other Contract Documents if interpretation is needed, etc. The Contract Documents are as follows (1) the Negotiated Modifications, if any are mutually-agreed to by the Authority and the successful Offeror; (2) the Proposed Modifications, if any are mutually-agreed to by the Authority and the successful Offeror; (3) this RFP; (4) the Supplemental Conditions; (5) the Agreement; (6) Bid Instructions & Guidelines- “Waldrep Spec Building” dated April 1, 2004; (7) Addendum #1, dated March 17, 2004; (8) Addendum #2, dated March 29, 2004; (9) Addendum #3, dated April 1, 2004; (10) Sheet “Office Layout- Waldrep Spec Building”, dated March 30, 2004; and (11) Sheet “Site & Facility Improvements- Waldrep Spec Building”,  dated April 1, 2004”.  (Contract Documents numbered (6)-(9) shall be interpreted to refer to competitive sealed proposals, instead of bids). The executed Agreement, which shall incorporate the other Contract Documents, is referred to as the “Contract.”

Scope of Work: Services include both design and construction for the Project as described in this RFP. Design work includes furnishing “stamped drawings” for City of Dublin permits as follows: (1) architectural drawings for office; (2) structural drawings for mezzanine and building addition; (3) plumbing; (4) HVAC; (5) electrical; (6) site plans, as follows: (a) storm water retention; (b) land disturbance permit; and (c) erosion control systems.

Other requirements/Questions: There are no mandatory requirements relating to the prequalification of Offerors or to the receipt of federal assistance or funds.  There will be no pre-bid conferences. Offerors should contact only the Executive Director of the Authority, Ms. Willie Paulk, to clarify any part of this RFP. All questions that arise prior to July 2, 2004 at 5:00 PM should be directed to the Executive Director, preferably in writing via facsimile transmission at 478-275-0811. Any unauthorized contact shall not be used as a basis for responding to this RFP and also may result in the disqualification of the Offeror's Proposal.

Basis for Award: The Authority will award the Contract in accordance with the following procedure-

·         The Selection Committee, described below, will assign between 0 and 10 points to each of the Evaluation Factors listed below in each Proposal received by the due date and time.  The points will be multiplied by its appropriate weight and the Proposals will be ranked based on the total points received by each Proposal.

·         All Offerors that are not responsible and responsive will be eliminated.  Offerors that do not achieve an aggregate score of 150 based on above criteria will not be deemed reasonably susceptible of being selected for award and will be eliminated.

·         If only a single Offeror remains, the Proposal will be deemed most advantageous to the Authority, and the Selection Committee will make a recommendation to the Members of the Authority to award the Contract to the Offeror, provided, that before making such recommendation, the Selection Committee may pursue discussions, negotiations and revisions of the Offeror’s Proposal in order to obtain its “best and final offer”, in which case the best and final offer will be recommended.  If more than one Proposal remains, those Offerors who were not eliminated in the previous step will be afforded the opportunity to participate in discussions, negotiations and revisions of their Proposals in order to obtain their “best and final offers”.  Offeror(s) included in such discussions, negotiations and revisions are sometimes referred to in this RFP as the “short listed” Offeror(s).

·         The “best and final offers” (if more than one) will be re-evaluated and ranked based on the same Evaluation Factors used earlier and the Selection Committee will make a recommendation to the Members of the Authority to award the Contract to the Offeror with the highest ranking.

·         The Members of the Authority will vote on the Selection Committee’s recommendation.  The Members’ vote shall be final. The Members’ approval of the award to the recommended Offeror will be documented in writing as the determination of the Authority that such Offeror’s Proposal is the most advantageous to the Authority taking into account the Evaluation Factors set forth in the RFP.

Evaluation Factors: The Authority may assign to each Proposal for each of the following Evaluation Factors up to the maximum number of points allowed (10), based on its review of each Offeror’s Proposal-

·         Qualifications and Experience of Design/Build Team (weight = 2.0)

·         Qualifications and Experience of Proposed Staff (weight = 2.0)

·         Project Understanding (weight = 3.0)

·         Familiarity with building projects in the Authority’s area of operations (weight = 3.0)

·         References (weight = 1.5)

·         Financial Capacity (weight = 1.0)

·         Project Management Plan (weight = 1.5)

·         Project Completion Schedule (weight = 3.0)

·         Price (weight = 2.0)

Selection Committee: The Selection Committee will consist of the following -

·          The Treasurer of the Authority

·         The Executive Director of the Authority

·         Representative of Company

·         Representative of Company

Bid Security/Affidavit: By submitting its Proposal, each Offeror agrees to comply with the Act’s requirements pertaining to bid/proposal, payment and performance bonds. Each Offeror must provide proposal security in the form of a bid bond, cashier’s check, certified check (payable to and for the protection of the Authority) or cash deposit in an amount equal to at least 5% of the total amount payable by the terms of the Contract as proposed by the Offeror. Payment and performance bonds in the amount of 100% of the total amount payable by the terms of the Contract are required for this Project, and Offerors must also provide a letter of intent from a surety with an A.M. Best rating of at least “A” indicating that it is willing to provide the Offeror with 100% payment and performance bonds for this Project should the Offeror be selected. The bid bond, performance bond, and payment bond must be approved as to form and as to the solvency of the surety by the Treasurer of the Authority. Offerors will be required to honor their Proposals for 60 days from the date the Proposals are opened; however, if an Offeror is not selected within 60 days of opening the Proposals, any Offeror that is determined by the Authority to be unlikely of being selected for Contract award shall be released from its Proposal. By submitting a Proposal, the Offeror represents and agrees that it has not directly or indirectly prevented or attempted to prevent competition by any means, has not prevented or endeavored to prevent anyone from making a Proposal by any means, and has not caused or induced another to withdraw a Proposal for the work. Prior to commencing the work, the successful Offeror shall be required to make an oath in writing to this effect.

Proposal Process: All Proposals must be in writing.  Proposals must contain (a) all information necessary for the Authority to apply the Evaluation Factors set forth above, (b) proposal security and a surety’s letter of intent as described above, and (c) the form of the proposed Agreement.  The form of the proposed Agreement must be (a) Part 2 of AIA Document A191, 1996 Edition, completed and priced (1) to show the proposed stipulated sum/lump-sum,  which must be broken down into the components of the Project as prescribed in the Contract Doucments, and (2) to provide for payment of the cost of the work less 10% retainage determined as a percentage of the actual cost of the work less 10% retainage, (b) together with any Proposed Modifications.  The Agreement must also provide for compliance with the Act’s requirements regarding the notice of commencement, including, without limitation, the posting and filing thereof.  Offerors must submit one original of the Proposal signed by an authorized representative of the Offeror, together with three conformed copies.  Proposals must be in a sealed  envelope addressed to the Authority, marked with the Offeror’s name and address and labeled “RFP 01/04 DESIGN/BUILD OF THE WALDREP SPEC BUILDING”.  The Authority must actually receive each Offeror’s Proposal at its offices located at 1200 Bellevue Avenue, Dublin, Laurens County, Georgia 31040, no later than 5 o’clock, p.m. on July 9, 2004, at which time the Proposals submitted shall be opened by a representative of the Selection Committee.  Proposals received after said date and time will not be considered.  The Selection Committee will evaluate Proposals on July 9, 2004. The Selection Committee will also interview short-listed firms, if necessary for purposes of discussions, negotiations and revisions, on July 9, 2004.  On July 9, 2004, the Selection Committee will recommend to the Authority an Offeror to receive the award of the Contract.  The Authority will award the Contract on July 9, 2004.  The Authority reserves the right to reject any and all Proposals, to waive any technicalities or informalities and to award the Contract based on what Proposal is determined in writing to be the most advantageous to the Authority, taking into account the Evaluation Factors set forth in this RFP.

DESCRIPTION OF PROJECT SITE

All that tract of land in the City of Dublin, Laurens County, Georgia, containing 13.81 acres, more or less, and being shown on a plat of survey by Boyce L. Young, Land Surveyor, dated January 7, 1999.  Said property fronts 910.98 feet on the northwesterly margin of Waldrep Industrial Boulevard and extends back in a northwesterly direction 660 feet, more or less.  Said property is bounded now or formerly as follows:   Southeast by Waldrep Industrial Boulevard; southwest and northwest by property of City of Dublin and County of  Laurens Development Authority; and northeast by property of Parker Hannifin Corporation.
